These Terms and Conditions govern your use of our services, website, and any agreements for excavation work. By engaging with us, you agree to comply with these terms.

1. Services and Agreements

All services (e.g., site prep, trenching, septic installation) are outlined in a written contract, including scope, pricing, and timelines.
Verbal agreements are non-binding until formalized in writing. We reserve the right to refuse service for safety, legal, or logistical concerns.

2. Pricing and Payments

Quotes are valid for 30 days unless otherwise stated.
A 20% deposit is required to secure your project start date. Progress payments (e.g., 50% midway) and final payment (30%) are due as outlined in your contract. Late payments incur a 1.5% monthly interest fee.

3. Project Delays & Changes

Delays due to weather, permits, or unforeseen site conditions (e.g., rock, underground utilities) may adjust timelines.
Client-requested changes must be submitted in writing; additional costs or delays may apply.

4. Property and Safety

Clients must disclose property boundaries, underground utilities, and hazards before work begins. We are not liable for damage to unmarked utilities or unauthorized structures.
Safety protocols must be followed; clients/visitors assume risk on active worksites.

5. Warranties & Liability

Excavation work is guaranteed for 1 year post-completion (excludes third-party work or natural events). We carry general liability insurance but are not responsible for pre-existing property conditions.

6. Permits & Compliance

Permits are the client's responsibility unless included in the contract. Projects must comply with local regulations; non-compliance voids warranties.

7. Cancellation Policy

Cancellations within 48 hours of scheduled work forfeit the deposit. Material or equipment orders canceled by the client are non-refundable.

8. Dispute Resolution

Disputes will first be resolved through mediation in County, State. Legal actions must be filed within 1 year of project completion.

9. Website Use

Content (text, images, logos) is owned by Black Stag Excavation and may not be reused without permission. We are not responsible for third-party links or user-generated content.
